Agreement to Terms

By visiting ploutosbudget.com or using our applications or software (the “Site”), you, the visitor, agree to the terms of this agreement. The following terms and conditions govern your access to and use of the budgeting software available through our apps, software, and the website. This agreement is subject to change at any time. All changes are effective immediately.

The Site is offered and available to users who are 13 years of age or older. By using the Site, you represent and warrant that you are of legal age to form a binding contract with Ploutos Studios and meet all the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site. Registering on behalf of another who does not meet this age requirement is itself a violation of these Terms.

No Warranty

No warranty is made by Ploutos Studios, regarding any information, services or products provided through, or in connection with, the Site. Ploutos Studios, hereby expressly disclaims any and all warranties, including without limitation: any warranties as to the availability, accuracy or content of information, products or services. We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.

We are not responsible for the accuracy of financial data obtained from third-party sites that are displayed or reported through the Site or any of our services. Ploutos Studios, however, is not responsible for and cannot guarantee the accuracy or timeliness of financial account we retrieve on your behalf directly, from third party technology providers, from third party financial institutions where your accounts are held, or from third party data providers used to provide services.

Ploutos Studios may not be able to foresee or anticipate technical or other difficulties which may result in failure to obtain data, personalization settings or other service interruptions. Ploutos Studios assumes no responsibility for the timeliness, accuracy, deletion, non-delivery or failure to store any user data, loss of user data, communications or personalization settings.

Account Security

Should you, at your discretion, choose to share your email, password, or other security information with any other person or entity in order to share access, we disclaim all liability for anything that person or entity may do to compromise the security of your account.

You agree to notify us immediately of any unauthorized access to or use of your email or password or any other breach of security. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any email, password or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms of Service.

Geographic Restrictions

The Site and web-based services are intended for access and use within the United States only. The Site and web-based services are not intended for or directed to citizens, domiciles or residents of the European Union. Accordingly, our sites and web-based services comply with applicable United States privacy laws. By accessing the Site and web-based services, you affirm that you are not a citizen, domicile or resident of the European Union.

Your Email Address

Ploutos Studios does not sell or share your email address to third-parties, except to deliver any services you have requested. Users agree to provide Ploutos Studios, with an up-to-date email address.

Limitation on Liability

IN NO EVENT WILL THE COMPANY, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF THE COMPANY AND ITS SUBSIDIARIES AND AFFILIATES, AND THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS AND DIRECTORS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID TO THE COMPANY FOR THE APPLICABLE CONTENT, PRODUCT, OR SERVICE IN THE LAST TWELVE MONTHS OUT OF WHICH LIABILITY AROSE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
